Die aktuelle Debatte zum „Schmähgedicht“ von Jan Böhmermann wirft ein Schlaglicht auf die Frage, inwieweit der Kontext bei der Beurteilung rechtlicher Fragestellungen berücksichtigt werden muss: Kann eine an sich diffamierende Äußerung rechtmäßig sein, wenn sie sich im Gesamtzusammenhang als Satire darstellt? Der vorliegende Beitrag knüpft an diese öffentlich geführte Diskussion an, um auf einem Streifzug durch das Urheberrecht auf Spurensuche zu gehen, ob und inwieweit die Kontextualität etwa für die Werkseigenschaft oder die Schrankenregelungen Relevanz besitzt.


The recent discussion about the poem called "Schmähgedicht" by Jan Böhmermann shines a spotlight on the question whether context matters in the evaluation of legal problems: Can a defamatory statement be lawful when the whole context shows it is meant to be satire? The authors take the public discussion on this as a starting point to have a closer look at the influence of context on copyright law, whether it is to determine if something qualifies as a work or to evaluate the scope of the limitations on copyright.
