Die Arbeit der Limbach-Kommission ist im letzten Jahr in Kritik geraten, dies im Zusammenhang mit ihrer Empfehlung vom 21. März 2016 in Sachen der Erben nach Alfred Flechtheim gegen die Stiftung Kunstsammlung Nordrhein-Westfalen in Düsseldorf. Vor diesem Hintergrund entwickelt der Beitrag allgemein-normtheoretische Prämissen zur Produktion von „gerechten und fairen Lösungen“ im Sinne der Washingtoner Prinzipien, dies sowohl auf der Ebene der Verfahrensorganisation als auch auf der Ebene materieller Empfehlungsprinzipien. Diese Prämissen werden mit der früheren und nunmehr reformierten Gestalt der Kommission kritisch in Verhältnis gesetzt. Zur weiteren Verbesserung wird vor allem die Erarbeitung eines „Restatement of Restitution Principles“ vorgeschlagen, um die „Grammatik“ der Empfehlungsgründe künftig besser sichtbar zu machen, Inkonsistenzen zu vermeiden und so die Akzeptanz der insgesamt überzeugenden Arbeit der Kommission weiter zu fördern.
The work of the German Advisory Commission (the „Limbach-Kommission”) has come under criticism last year in connection with its recommendation of 21 March 2016 in the matter of the Heirs of Alfred Flechtheim and the Stiftung Kunstsammlung Nordrhein-Westfalen in Düsseldorf. Against this background this paper develops abstractly normative premises for the production of “just and fair” solutions in the sense of the Washington Principles, both on the level of procedural organization and substantive principles, and the past and reformed structure of the Commission is measured against this general and theoretical standard. In order to further improve the generally convincing work of the Commission, it is, inter alia, submitted that a “Restatement of Restitution Principles” should be developed because such a set of principles and comments on its interrelations would make recommendations more consistent, more transparent and thus would meet more easily with the approval by the parties and the public.
